1. Introduction

Welcome to DiskiLink.co.za ("DiskiLink", "we", "us", "our"). By accessing or using our website, mobile application, and related services (collectively, the "Platform"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, please do not use our Platform.

2. Definitions

• "User" – Any person who registers or uses the Platform, including players, team managers, and tournament organizers.
• "Organizer" – A User who creates, manages, or hosts a tournament or match on the Platform.
• "Participant" – A User who joins a tournament or match organized by another User.
• "Joining Fee" – The platform fee charged by DiskiLink for using our services to join a tournament.
• "Entry Fee" – The fee set by the Organizer that Participants pay directly to the Organizer (DiskiLink does NOT collect entry fees).

3. Eligibility

You must be at least 13 years old to use the Platform. Users under 18 must have parental or guardian consent. By using the Platform, you represent that you meet these requirements.

4. Account Registration

You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate, current, and complete information during registration. You are solely responsible for all activities that occur under your account.

5. User Conduct

You agree not to:

• Use the Platform for any illegal purpose or in violation of any applicable laws
• Harass, abuse, or harm other users
• Impersonate any person or entity
• Post false, misleading, or fraudulent information
• Attempt to gain unauthorized access to our systems
• Create multiple accounts to bypass limits or restrictions

6. Tournament and Match Creation

Organizers are solely responsible for:

• Accuracy of tournament details (dates, times, locations, rules)
• Collection of entry fees (DiskiLink does not handle entry fees)
• Payment of prizes or winnings to Participants
• Safety and conduct at physical events
• Compliance with all applicable laws and regulations

Payment Terms

7. Joining Fees (DiskiLink Platform Fee)

• Joining fees are charged to Participants when they join a tournament
• Joining fees are based on tournament size: R5 (≤8 teams), R10 (9-16 teams), R15 (17-32 teams), R20 (33+ teams)
• Joining fees are non-refundable except as provided in our Refund Policy
• Payments are processed securely through Ozow

8. Subscriptions

• Organizers may purchase subscription plans (Silver, Gold, Platinum) for additional features
• Subscriptions are billed monthly and expire after 30 days
• Subscription fees are non-refundable
• Organizers may cancel their subscription at any time, but no refunds are provided for partial months

9. Entry Fees (Paid to Organizers)

• DiskiLink does NOT collect, hold, or process entry fees from Participants
• Entry fees are paid directly by Participants to Organizers
• DiskiLink is not responsible for disputes regarding entry fees
• Organizers must clearly communicate entry fee amounts and payment methods

Refund Policy

10. Joining Fee Refunds

• Full Refund: If a tournament is cancelled by the Organizer before any matches have been played
• Partial Refund: May be considered if a Participant withdraws more than 7 days before the tournament start date
• No Refund: After the tournament has started or if the Participant cancels within 7 days of the tournament date
• Refund requests must be submitted to refunds@diskilink.co.za within 14 days of the payment date
• Approved refunds are processed within 7-14 business days

11. Subscription Refunds

• Subscription fees are non-refundable
• Upon cancellation, the subscription remains active until the current period ends
• No refunds are issued for unused subscription time

12. Cancellation and Postponement

• Organizers may postpone tournaments subject to plan limits (Bronze: 1, Silver: 2, Gold: 3, Platinum: 5)
• Organizers may cancel tournaments only if fewer teams have joined than the plan threshold
• DiskiLink reserves the right to cancel or suspend any tournament that violates these Terms

Privacy Policy

13. Information We Collect

• Personal Information: Name, email address, phone number, date of birth, gender
• Account Information: Login credentials, subscription status, tournament history
• Payment Information: Processed by Ozow (DiskiLink does not store credit card details)
• Technical Data: IP address, browser type, device information, location data (if consented)
• Usage Data: Tournament participation, team management, match statistics

14. How We Use Your Information

• To provide and maintain our services
• To process payments and verify transactions
• To communicate with you about tournaments, updates, and support
• To improve and personalize your experience
• To detect and prevent fraud or abuse
• To comply with legal obligations

15. Information Sharing

• We do not sell, rent, or trade your personal information
• We share information with trusted third parties only as necessary (payment processors, email services)
• Tournament organizers can see your team name and contact information when you join their tournament
• We may disclose information if required by law or to protect our rights

16. Data Security

• We implement industry-standard security measures to protect your data
• All payment transactions are encrypted using SSL/TLS technology
• While we strive to protect your information, no method of transmission is 100% secure

17. Data Retention

• We retain your information as long as your account is active
• After account deletion, we retain certain information for legal compliance (e.g., payment records for 5 years)
• You may request deletion of your data by contacting privacy@diskilink.co.za

POPIA Compliance (South Africa)

18. Your Rights Under POPIA

In accordance with the Protection of Personal Information Act (POPIA) of South Africa, you have the right to:

• Access: Request a copy of your personal information held by us
• Correction: Request correction of inaccurate or incomplete information
• Deletion: Request deletion of your personal information (subject to legal retention requirements)
• Objection: Object to the processing of your personal information
• Portability: Request transfer of your data to another service provider
• Withdraw Consent: Withdraw consent for processing where consent was required

19. Information Officer

DiskiLink's Information Officer is responsible for POPIA compliance. You may contact them at popia@diskilink.co.za.

20. Data Breach Notification

In the event of a data breach that may compromise your personal information, we will notify you and the Information Regulator within 72 hours as required by POPIA.

Disclaimer of Warranties & Limitation of Liability

21. "As Is" Basis

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. DiskiLink makes no warranties regarding the reliability, availability, or functionality of the Platform.

22. Liability Limitation

To the maximum extent permitted by law, DiskiLink shall not be liable for:

• Injuries, accidents, or losses occurring during tournaments or matches
• Disputes between Organizers and Participants regarding entry fees
• Any indirect, incidental, or consequential damages
• Loss of data, revenue, or profits

DiskiLink's total liability shall not exceed the total amount of fees paid by you to DiskiLink in the 12 months preceding the claim.

23. Indemnification

You agree to indemnify and hold DiskiLink harmless from any claims, damages, or expenses arising from your use of the Platform or violation of these Terms.

24. Modifications to Terms

DiskiLink reserves the right to modify these Terms at any time. Changes become effective upon posting to the Platform. Your continued use of the Platform constitutes acceptance of the revised Terms. Material changes will be communicated via email or platform notification.

25. Termination

We may suspend or terminate your account at our sole discretion for violation of these Terms. Upon termination, you forfeit any unused subscription time or credits.

26. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes shall be resolved in the courts of Gauteng, South Africa.
